Por qué el Congreso necesita aprobar una extensión temporal imperfecta para DACA
Hace una década, EE. UU. comenzó a aceptar solicitudes de inmigrantes jóvenes para el programa de Acción Diferida para los Llegados en la Infancia (DACA). Cientos de miles de adolescentes y adultos jóvenes que llegaron a los EE. UU. cuando eran niños sin estatus legal hicieron fila para presentar su solicitud. Ahora, aproximadamente 610,000 beneficiarios de DACA aún dependen de extensiones de dos años para vivir y trabajar en el único país que conocen, todo mientras el programa en sí es impugnado nuevamente en los tribunales. Sin una intervención oportuna del Congreso que brinde protección provisional, los Dreamers podrían comenzar a ser deportados.
El mes pasado, un panel de tres jueces en la Corte de Apelaciones del Quinto Circuito de EE. UU. en Nueva Orleans escuchó los argumentos orales encabezados por el fiscal general de Texas, quien argumentó que el programa DACA excedía la autoridad ejecutiva y le costó a Texas cientos de millones de dólares. Por el contrario, el Departamento de Justicia de EE. UU. defendió el programa, librando una batalla cuesta arriba contra un juez federal en Texas que dictaminó hace un año que declaraba ilegal a DACA. Mientras tanto, los beneficiarios actuales de DACA todavía pueden solicitar renovaciones, pero los nuevos solicitantes no tienen suerte. Independientemente del resultado del Quinto Circuito (esperado para este otoño), se apelará ante la Corte Suprema, que podría fallar para el verano de 2023.
No hay duda de que SCOTUS se abstendrá de cancelar el programa DACA, lo que crea rápidamente un escenario en el que cientos de miles de beneficiarios elegibles de DACA quedan sin estatus legal. Para los beneficiarios actuales de DACA, es probable que tengan hasta el vencimiento de su extensión, menos de dos años, antes de perder también el estatus legal.
Los soñadores de hoy son profesionales, padres, propietarios de viviendas y miembros destacados de sus comunidades. Aún así, su futuro es más precario que nunca. La posible expulsión de esta población tendría repercusiones económicas, financieras, familiares y sociales devastadoras y duraderas.
Terminar la autorización de trabajo para los beneficiarios de DACA empleados tendrá consecuencias enormemente negativas que se extenderán por todo el país y todos los sectores de la economía. El American Action Forum encuentra que los beneficiarios de DACA contribuyen con casi $42 mil millones al PIB anual y tienen un impacto fiscal positivo neto de $3.4 mil millones anuales.
También hay implicaciones para las familias. Más de una cuarta parte de los beneficiarios de DACA están casados y más de un tercio tienen hijos. El noventa y nueve por ciento de esos niños son ciudadanos estadounidenses. Y 75.000 beneficiarios de DACA tienen hipotecas.
A la luz de estos hechos, ¿dónde está el Congreso? A pesar de que los beneficiarios de DACA disfrutan del apoyo bipartidista entre los legisladores republicanos y demócratas y sus electores, la codificación del programa ha permanecido fuera del alcance político. Con un calendario legislativo repleto y un abismo cada vez mayor entre los partidos sobre cómo asegurar la frontera, la elaboración de un sólido paquete de inmigración está fuera de la mesa de este Congreso.
Y aún así, los candidatos, desde la extrema derecha hasta los progresistas, están haciendo campaña sobre mensajes de inmigración. Durante años, los demócratas han hecho campaña para proteger a los soñadores, prometiendo beneficios significativos al proporcionar un estatus legal permanente, no solo para las poblaciones elegibles para DACA sino también para sus padres. Al prometer resultados quijotescos a los Dreamers, los demócratas han cortado de manera efectiva las posibles negociaciones con el cuadro (ciertamente limitado) de republicanos que podrían unirse para dejar atrás este problema.
Y es cierto que muchos republicanos también apoyan la legalización de los Dreamers que llegaron de niños. Pero se han visto obstaculizados por movimientos estratégicos de los defensores de la inmigración que insisten en cambios drásticos en el asilo y revisiones de otras disposiciones legales de inmigración.
La opción menos que ideal ahora es que los legisladores reconozcan las realidades políticas y reorienten sus esfuerzos para reducir el daño asociado con la terminación pendiente de DACA, las implicaciones para los trabajadores y empleadores, y las enormes repercusiones negativas para las familias, las empresas y los comunidades
Abarrotar la solución restringida para incluir poblaciones más grandes, los padres, la frontera o el asilo es una receta para el desastre y, en última instancia, la inacción. Más bien, para fin de año, el Congreso debe concentrarse en aprobar una extensión limitada y temporal del estatus legal y la autorización de trabajo para los beneficiarios actuales de DACA y el creciente número de solicitantes que el tribunal de distrito bloqueó para procesar sus solicitudes.
Esta solución es reconocidamente insatisfactoria, imperfecta y temporal. Pero con las decisiones judiciales a la vista y el liderazgo republicano negándose a ayudar a los Dreamers en el próximo Congreso, un proyecto de ley defectuoso es mejor que ningún proyecto de ley.
Debemos dejar de jugar a la ruleta con la vida de las personas y el futuro de sus hijos y esperar que esta solución abra la puerta a las negociaciones sobre el estatus permanente a la luz de una decisión pendiente de la Corte Suprema. Además, debería estimular futuras conversaciones que aborden la miríada de problemas de inmigración que necesitan desesperadamente una reforma. Posponer estas conversaciones cruciales puede parecer ineficaz, pero es la acción más importante que el Congreso puede administrar de manera realista este año, dadas las realidades políticas, legales y normativas.
Necesitamos acción para preservar la capacidad de los Dreamers para trabajar y vivir en los EE. UU. El único trato que los legisladores, defensores y Dreamers deberían alentar es el que pueda aprobarse. Cualquier cosa menos, en este punto, es mala práctica política.
