El gobernador de Virginia Occidental firma un proyecto de ley que prohíbe el aborto con pocas excepciones
El gobernador de West Virginia, Jim Justice, anunció el viernes que firmó un proyecto de ley que prohíbe casi todos los abortos, excepto en ciertas situaciones médicas o en casos de violación o incesto.
La legislatura liderada por el Partido Republicano aprobó el Proyecto de Ley 302 de la Cámara de Representantes el martes en una sesión especial, convirtiendo a Virginia Occidental en el segundo estado en aprobar un proyecto de ley restrictivo sobre el aborto después de que la Corte Suprema de EE. UU. anuló Roe v. Wade.
La prohibición entra en vigencia de inmediato, y las sanciones penales del proyecto de ley entrarán en vigencia en 90 días.
HB 302 permite excepciones para casos de violación o incesto hasta ocho semanas de embarazo para adultos y las primeras 14 semanas de embarazo para menores. El incidente deberá ser informado a la policía al menos 48 horas antes del aborto.
También permite excepciones si el embrión o feto no es viable, existe una emergencia médica o un embarazo ectópico, un evento raro en el que el óvulo fertilizado se implanta fuera del útero y no puede sobrevivir.
“Hice exactamente lo que dije que haría: lo firmé”, dijo Justice, un republicano, en una conferencia de prensa el viernes por la mañana.
Justice dijo que está «orgulloso de haberlo firmado y creo de todo corazón que hace una cosa que es absolutamente importante: protege la vida».
La HB 302 se estancó en julio cuando los legisladores no lograron llegar a un consenso sobre los detalles clave del proyecto de ley. Esta semana, cuando regresó la legislatura, los defensores del derecho al aborto criticaron a los legisladores por votar para prohibir el aborto “después de semanas de discusiones a puerta cerrada”.
Desde julio, el aborto era legal en Virginia Occidental hasta las 20 semanas de embarazo, después de que una jueza de un tribunal estatal indicara que había decidido bloquear una prohibición estatal del aborto que databa del siglo XIX.
Ese mes, la justicia convocó a los legisladores a una sesión especial y, en el último minuto, agregó el aborto a la agenda legislativa.
“Dije una y otra vez que defiendo firmemente la vida”, dijo Justice el viernes. “Pero también dije que tenemos que tener excepciones razonables, razonables y lógicas”.
“Y realmente creo que hay excepciones razonables y lógicas que nos trajeron. Ahora, con todo eso, este es un proyecto de ley muy volátil. Hay personas que van, en ambos lados, que probablemente no obtendrán todo lo que querían”, dijo.
Una persona que no sea un profesional médico con licencia que realice un aborto en violación de la ley estaría sujeta a un delito grave y hasta 10 años de prisión.
Según la ley, los abortos espontáneos, los mortinatos, la fertilización in vitro y el tratamiento médico que resulte en la muerte accidental o no intencional de un feto no se consideran abortos. La ley no impide la venta y el uso de anticonceptivos. Los proveedores de servicios de aborto deben informar los abortos y están obligados a notificar a los padres de un menor antes de realizar un aborto.
Define las emergencias médicas como una “condición o circunstancia que complica tanto la condición médica de una paciente que requiere un aborto para evitar un riesgo grave de muerte de la paciente o un riesgo grave de deterioro físico sustancial de una función corporal importante que pone en peligro la vida, sin incluir condiciones psicológicas o emocionales”.
Alisa Clements, directora de asuntos públicos de Planned Parenthood South Atlantic, argumentó que la ley “será mortal para la gente de nuestro estado”.
“Las excepciones limitadas en este proyecto de ley son tan limitadas y tan estrictamente restringidas que hará que sea extremadamente difícil para las personas en situaciones vulnerables, incluidos menores y sobrevivientes de agresión sexual, obtener la atención que necesitan”, dijo Clements en un comunicado.
