ICE expulsó a 33 niños inmigrantes a Guatemala después de que un juez dijera que no podían
La administración Trump expulsó a Guatemala a 33 niños que llegaron a Estados Unidos sin uno de sus padres después de que un juez federal emitiera una orden judicial preliminar bloqueando la controvertida práctica ese mismo día.
La orden judicial fue emitida el miércoles por el juez estadounidense Emmet Sullivan minutos antes de que un vuelo del Servicio de Inmigración y Control de Aduanas (ICE) partiera hacia la ciudad de Guatemala con los 33 niños.
Un funcionario de ICE confirmó que el vuelo partió «poco antes de que se informara a ICE de la orden judicial» contra el Título 42, la disposición de salud pública utilizada por la administración Trump para expulsar a personas de los EE. UU. Citando la pandemia de coronavirus.
El funcionario dijo que los oficiales de ICE en tierra no se enteraron de la orden del juez hasta que el vuelo aterrizó y las autoridades guatemaltecas estaban saludando a los niños, quienes permanecían en Guatemala hasta el martes.
“Somos conscientes de la situación y la estamos investigando. Con suerte, a ningún niño se le niega el beneficio del fallo ”, dijo Lee Gelernt, un abogado de la ACLU que encabezó la demanda que resultó en la orden judicial preliminar que bloqueó la política.
La expulsión de los 33 niños ocurrida el mismo día de la orden de Sullivan podría obligar a la agencia a traer de regreso a los niños porque violó la decisión del juez, dijeron expertos legales.
“Es inconcebible que estén dejando a los niños allí y que no los hayan traído de regreso inmediatamente”, dijo Sarah Pierce, analista del Migration Policy Institute. Incluso si el vuelo despegó antes de que los funcionarios de ICE lo supieran, agregó, «la expulsión no es solo poner a los niños en el avión y despegar, también los está colocando en otro país».
