El administrador de Biden demanda a Arizona por la creación del muro fronterizo de contenedores de envío para detener la inmigración ilegal
El miércoles, la administración de Biden demandó al estado de Arizona por la construcción de un muro fronterizo improvisado utilizando contenedores de envío y alambre de púas para evitar el flujo de inmigrantes ilegales, y la administración afirmó que el estado está invadiendo tierras federales.
La demanda, presentada en el Tribunal de Distrito de los EE. UU., dice que la instalación de contenedores de envío de varias toneladas, cerrados con soldadura y rematados con alambre de púas, «dañan las tierras federales, amenazan la seguridad pública e impiden la capacidad de agencias y funcionarios federales, incluido el personal encargado de hacer cumplir la ley, para desempeñar sus funciones oficiales».
La demanda es el último tira y afloja entre el gobernador de Arizona, Doug Ducey, y la administración de Biden sobre la decisión de Ducey a principios de este año de llenar los vacíos en el muro fronterizo con contenedores de envío. La construcción consistió en 60 contenedores de envío de doble apilamiento, cerrados con soldadura y rematados con cuatro pies de alambre de púas. Su oficina dijo que mide 22 pies de alto y pesa casi 9,000 libras.
El gigante del metal ha generado quejas de activistas sobre el impacto en el medio ambiente, así como continuas preocupaciones humanitarias sobre los muros que impiden que los inmigrantes ingresen más profundamente en territorio estadounidense.
El gobierno federal, a través de la Oficina de Reclamación, ha emitido advertencias a Arizona, alegando que los contenedores estaban en las inmediaciones de la represa Morelos y también en terrenos que forman parte de la Reserva del Oeste de la Tribu Indígena Cocopah. También dijo que la colocación interfiere con un proyecto de Aduanas y Protección Fronteriza (CBP, por sus siglas en inglés) para llenar los vacíos, y pide a Arizona que detenga la construcción y ayude a retirar los contenedores.
Arizona respondió a lo que llamó una «falta de coordinación» de las agencias federales y dijo que estados como Arizona «no pueden depender del gobierno federal para garantizar su seguridad».
En octubre, la administración de Ducey presentó una demanda por el asunto, buscando afirmar que tiene derecho a defenderse.
“Nuestras comunidades fronterizas están abrumadas por la actividad ilegal como resultado del fracaso de la administración Biden para asegurar la frontera sur”, dijo Ducey en un comunicado. «Arizona está tomando medidas para protestar en nombre de nuestros ciudadanos. Pero ahora la administración ha retrocedido con una demanda, continuando con su afirmación de que Arizona está invadiendo tierras federales y buscando una compensación del estado.
“Arizona no solo se ha negado a detener sus intrusiones y retirar los contenedores de envío de tierras federales, sino que ha indicado que continuará invadiendo tierras federales e instalará contenedores de envío adicionales”, dice la demanda. «Como resultado, Estados Unidos presenta esta acción para obtener la reparación adecuada por las continuas infracciones e invasiones ilegales de Arizona de los derechos e intereses de propiedad soberanos supremos de Estados Unidos en virtud de la Constitución de Estados Unidos».
